Terms of Service

By purchasing from me, you are stating you have read and agree to these terms.TurnaroundExpect about 1-3 weeks, depending on the type of commission ordered. Turnaround time may be longer than anticipated due to things coming up in my personal life and that I still have a day job.Rush orders are currently not available due to the unpredictability of my schedule. If you have a commission you want done before a specific date (ex. a birthday gift) we can discuss it.PaymentPayments through PayPal only. I will send you an invoice to the email you provided with your order total. Half the payment is required up front and half when completed. Payment plans can be discussed for orders over $100.I will not start your commission until the first half is paid, this allows me to still be paid for my time should I get started and you decided to cancel your order.You must, if prompted, select no shipping address needed. With my art being digital and not a physical item to be mailed, I have no tracking info to give PayPal.RefundsRefunds are not available after the commission is paid for in full. I will be checking with you throughout the process to make sure that it is coming out how you want. It is up to you to tell me any changes you want before the commission is finished and the final payment is sent.If you decide to cancel your commission contact me right away. The less time I've spent on it already the more of that first half of the payment you'll be able to get back. The amount you will be refunded is entirely dependent on how far I've gotten and there is a possibility that you might not be able to receive any of your first payment back. Emergencies do happen but be sure you can afford to commission me before you order.Refunds are not available for character designs once paid in full. Please be sure you can afford the design before purchasing. In the case of a partially paid off payment plan for a design you may cancel and receive a full refund and the design will go back up for sale.Canceling a commission or design purchase will not automatically get you blacklisted. Sometimes things come up, it happens. However if it becomes a regular occurrence it could result in you being blacklisted from future purchases.Commission Usage RightsAs the Artist I am allowed to post your commission to my social media sites and use in my portfolios for the purposes of promoting myself and my art and for work examples. If you don't want your commission posted anywhere publicly we can discuss it.As the Artist when posting your commission I will list you as the commissioner, either your name or a username, unless you request to be listed as anonymous.As the Commissioner you are not allowed to reproduce my art for commercial use. This includes but is not limited to; prints, shirts, mugs, bags, charms, buttons/pins, and any merchandise to be redistributed for sale.As the Commissioner you are allowed to use your commission for personal use only. You are allowed to make a single print for yourself or to print it onto a single item for yourself.As the Commissioner you are allowed to repost your commission provided you post my watermarked version AND credit me with a link back to this site. Exceptions being commissions made to be icons and banners, then the watermark is not required but credit still must be listed somewhere easily seen.Failure to adhere to these terms may result in being blacklisted.Character Design Usage RightsAs the Artist I am allowed to use the character design in portfolios and as general work examples for the purposes of promoting myself and my art. The design once sold will be no longer be listed as available and will purely be used for the sake of examples.As the Buyer you must give credit to me as the original designer wherever you host the character with a link back to this site or my Toyhouse account if hosted on Toyhouse. You may redesign the character provided they are still recognizable as the original and the original art and design is still attached and credited properly. You may give yourself credit for the redesign provided the differences are substantial enough and I am still credited for the original. You may edit my original art for minor changes (ex. changing the eye color, hair length) but you must keep the original unedited art with the character and you may not credit yourself as a designer for minor changes to the original design and art.As the Buyer you are not allowed to resell my designs for more than you paid. Should you have additional art of the character created you may then factor the value of the additional art into the resale value. Additional art includes commissioned art, art created by the current owner, and gift art with the permission of the artist who gifted the art. However attempting to increase the value of the design by rapidly creating art for the purpose of turning a profit is not allowed. Should you be caught doing this it may result in being blacklisted from future purchases.
Should you receive a design of mine in a trade or from a raffle you may still resell it following the same rules above. My designs do not lose monetary value simply by being traded. In the case of designs received for free (ex. raffled, gifted) there must be additional art created for the character before it can be resold.My designs are for personal use only. Commercial use can be discussed but will require an actual contract being written up. For the sake of ease commercial usage rights for my designs will only come into play in circumstances in which the project that involves them them is making or is planned/attempting to make money.Some examples where commercial use is not necessary:
-A project (such as a game, comic, or animation) where the design is used for an extremely minor or background character
-The design is used for a prominent character in a comic that is free to read or a game that is free to play with no patreon, microtransactions, or other monetization form attached to the projectSome examples where commercial use would be necessary:
-A project (such as a game, comic, or animation) that is being made to be sold to an audience where the design is used for a prominent character
-The design is used for a prominent character in a comic that is free to read online but has a patreon or donation link either specifically for that comic or being advertised on that comicRegardless of commercial or personal use, if the design is used for a prominent character in a project then credit for the design is required somewhere reasonable and relatively easy to find. For example if the design is used in a webcomic credit would not be required on every page the character appears but would be required on something like a character cast page.If you have questions about whether or not what you plan to do with a character design would require additional commercial usage rights feel free to contact me through email or Discord.OrderingYou can send a commission request through the form here. If you'd like to get a more accurate estimate you can contact me on Discord @agentcheshirecommissions. I will first contact you to confirm details and a price then I will send the invoice.Please give me all references I will need for what you want and any details you'd like to have in the commission. If you don't have any poses or specifics in mind and want me to come up with one please give me a brief description of the character's personality so I can do something that suits them.Extra FeesAll commission base prices are priced for a single character of low to mild complexity. Your commission may cost more than the base price due to various factors. These factors include:
-Complexity of the Character
-Extra Characters
-Backgrounds
-Props and EffectsIf you are unsure if your commission will incur a fee you may contact me for a quote.Major changes (new pose, outfit change, etc.) made after the line art has been completed will incur a fee of $5-$10 per change*. These changes are best brought up and easiest to implement during the thumbnail or sketch phase. Minor changes (slight color adjustments, small detail added, etc.) at any stage will not incur a fee.Changes done after the commission is complete will incur a fee of $5-$20 per change* depending on how much is altered. Minor changes to the finished commission, such as slight color adjustments, will not incur an edit fee. Changes to the finished commission that are something I missed in the references you sent me will also not incur a fee. Anything in a reference you did not directly send to me to use will still incur a fee.If the references you give me are unclear I will have to ask you for clarification and this will make the commission take longer. The clearer the reference the less likely you will have to pay a fee to fix things.I can work from descriptions and mood boards but this will incur a character design fee as I will essentially also be designing the character. This fee can range from +$20-$60 depending on complexity.*Per change refers to a change of the entire image. If you want the pose altered and some colors adjusted at one stage that is counted as one change. If you want the pose altered in the line phase and the colors adjusted after completion those are counted as two separate changes.What I will not draw
